1. Basic Terms
By accessing this website or subscribing to the services of FavSEO, you are agreeing to be bound by FavSEO’s following terms and conditions of use, all applicable laws and regulations, and agree that you are responsible for compliance with all the applicable local laws. If you do not agree with any of these terms, you are not allowed to use or access or subscribe to FavSEO’s website or Apps hosted on different platforms like BigCommerce, Shopify etc. The materials contained in this website are protected by the applicable copyright and trademark law.
We ask you to read FavSEO’s Terms & Conditions of Use & the Privacy Policy carefully because they override & supersede all the related documents which you might or might not have read about FavSEO.
2. Copyright and Ownership
2.1 FavSEO or its suppliers own the intellectual property rights to any and all protectable components of the service & app, including but, not limited to the name of the service & app, artwork and end-user interface elements contained within the service & app, many of the individual features, and the related documentation. Your usage of FavSEO’s services & app falls under the conditions mentioned under Use License below.
2.2 FavSEO claims no intellectual property rights or the responsibility of the Content you upload or provide to the service or app, such as the articles or meta descriptions.
3. Use License
3.1 Permission is granted to temporarily download one copy of the materials (information or software) available on FavSEO’s or its partners’ website & app for personal and commercial transitory viewing only. You are not allowed to resale the same. This is the grant of a license to use our service & the provided resources, not a transfer of title, and under this license, you may not:
3.1.1 Modify or copy the materials;
3.1.2 Use the materials for any commercial purpose, or for any public display (commercial or non-commercial) excepting the terms agreed upon during the sign-up;
3.1.3 Attempt to decompile or reverse engineer any software contained on FavSEO’s website & app;
3.1.4 Remove any copyright or other proprietary notations from the materials; or
3.1.5 Transfer the materials to another person or “mirror” the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and it may be terminated by FavSEO at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
4. Services
In order to deliver the service(s) & app for which you have signed-up for the free trial or purchased a plan of FavSEO, FavSEO agrees upon providing you with the resources including but not limited to:
4.1 Preparing & posting the content as decided upon the sign-up for the service.
4.2 Generating & sharing the reports as decided upon the sign-up
4.3 Providing access to the app on the basis of the nature of the plan- free or paid.
5. Account Terms
5.1 When you reach out to us with any enquiry about our service, you automatically get subscribed to our mailing list. However, you can unsubscribe from the Emails, by hitting the Unsubscribe button on the Email.
5.2 You are responsible for maintaining the security of your account by keeping your app credentials secured & not sharing them with anyone. FavSEO does not share your app credentials with anyone & cannot be held liable for any loss or damage to your information from your failure to comply with the security obligations
5.3 You are responsible for every piece of information that is processed through your account on the FavSEO app.
5.4 The decision to provide the service or not remains solely with FavSEO & FavSEO reserves the right to refuse service to anyone for any reason at any time.
Please note, FavSEO does NOT work with the businesses which deal in or promote, sexually explicit materials, violence, illegal activities, fake or counterfeit items, gambling or betting, discrimination based on race, sex, religion, nationality, disability, sexual orientation, or infringes upon others’ intellectual property rights.
5.5 In order to use FavSEO’s service or access any of the resources, you must sign-up with your legal full name & valid Email address & provided the correct credentials of the required accounts which belong to you.
6. Payments, Refunds, Upgrading and Downgrading Terms
6.1 Payments Terms: When you decide to upgrade your account to one of our paid plans & for the monthly payments, we ask you to make the payment through PayPal on recurring basis. Since FavSEO doesn’t access the classified payment details & receives only the payment confirmation details, you should contact PayPal in the case of any dispute related to payment.
6.2 Refunds:
There is no monthly contract for using our App and once we accept the payments, we do not proceed with full or partial refunds.
6.3 Upgrading/Downgrading Term
There are multiple plans ranging from free to paid and you may choose either of them as per your requirements. You may upgrade or downgrade the same using the App itself.
7. Termination Terms
7.1 You can ask us to discontinue our service on your website at any point of the time, over Email, phone or chat & within 24 hours we will surrender the access to all of your accounts & on your request, will delete all your information from our resources. You won’t be charged again after your official cancellation date.
7.2 Here, it is important to note that in order to fulfil the legitimate purpose of our business or the legal compliances, we may need to retain certain pieces of your information for certain period of time from the termination of our service.
7.3 FavSEO, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other FavSEO service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all content in your Account. FavSEO reserves the right to refuse service to anyone for any reason at any time.
8. Service & Prices Modification Terms
8.1 FavSEO reserves all the rights to modify or discontinue any or all the parts of our service or app at any time & from time to time, with or without prior notice.
8.2 FavSEO can modify or change the prices of its plans without any notice. In event of a change in the price, FavSEO reserves the right to decide whether the customers which started with the previous price(s) are going to pay the previous price(s) or the new one.
8.3 FavSEO shall not be liable, in any condition, to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
9. Revisions and Errata
The materials appearing on FavSEO’s website or app could include technical, typographical, or photographic errors. FavSEO does not warrant that any of the materials on the website are accurate, complete, or current. FavSEO may make changes to the materials contained on the website at any time without notice. FavSEO does not, however, make any commitment to update the materials.
10. Links
FavSEO has not reviewed all of the sites linked to its Internet website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by FavSEO of the site. Use of any such linked web site is at the user’s own risk.
11. Disclaimer
The materials on FavSEO’s website & app are provided “as is”. FavSEO makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, FavSEO does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
12. Limitations
In no event shall FavSEO or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on FavSEO’s internet website or app, even if FavSEO or a FavSEO authorized representative has been notified orally or in writing of the possibility of such damage. As some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
13. Governing Law
Any claim relating to FavSEO shall be governed by the laws of the State of Rajasthan (India), Judiciary in Jaipur, without regards to the laws of the location of the other party or to its conflict with other law provisions.
14. Update to these Terms & Conditions of Use
FavSEO reserves the right to change or update these terms & conditions of use from time to time. If material changes are made, we will inform you by Email, for the other minor changes, we will update the Last Revised On date, at the top of this page.
